1. Agreement
By creating an account or using ProtonScheduler Cloud ("the Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service. These Terms apply to the hosted cloud service at protonscheduler.eu. The self-hosted open-source software is governed solely by its MIT License.
2. Your Account
To use the Service, you must:
- Be at least 16 years of age
- Provide a valid email address
- Have or create a Solid Pod for data storage
- Keep your account credentials secure
You are responsible for all activity under your account. If you suspect unauthorized access, notify us immediately at [email protected].
3. Data Ownership
Specifically:
- Your Solid Pod data — Fully owned by you at all times. We never access, copy, or process the contents of your Pod beyond what's necessary to display your booking page and send notifications at your request.
- Account metadata — We store minimal metadata (email, subscription status, usage counts) to operate the Service. This is deleted when you close your account.
- Booking page content — The text, descriptions, and branding you set for your public booking pages are your content. You grant us a limited license to display this content publicly as part of operating your booking page.
4. Service Tiers and Billing
4a. Free tier
The Free tier is provided at no cost with usage limits (1 event type, 1 booking page, 25 bookings/month). We reserve the right to adjust Free tier limits with 30 days' notice.
4b. Paid tiers (Pro and Business)
- Subscriptions are billed monthly or annually via Stripe
- Prices are listed in EUR and may be updated with 30 days' notice
- You can upgrade, downgrade, or cancel at any time from your billing dashboard
- Downgrades and cancellations take effect at the end of the current billing period
- We do not prorate refunds for mid-cycle cancellations, except within the first 14 days (see Refund Policy below)
4c. Refund policy
If you're not satisfied with a paid plan, you may request a full refund within 14 days of your initial subscription or an upgrade. After 14 days, no refunds are issued for the current billing period, but you can cancel to prevent future charges. To request a refund, email [email protected].
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Send spam, phishing, or unsolicited commercial messages through booking pages
- Impersonate another person or entity
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to other users' accounts or data
- Use the Service for any activity that is harmful, fraudulent, or deceptive
- Exceed reasonable usage patterns that degrade the Service for others (e.g. automated abuse of the booking API)
We reserve the right to suspend or terminate accounts that violate these terms, with notice where reasonably possible.
6. API Usage
Business tier users have access to our REST API. API usage is subject to:
- Rate limits as documented in our API documentation
- The same acceptable use terms as the web interface
- API keys must be kept confidential; compromised keys should be revoked immediately
7. Availability and Support
We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. We may occasionally have downtime for maintenance, which we'll announce in advance when possible.
- Free tier — Community support via GitHub Issues
- Pro tier — Priority email support (48-hour response target)
- Business tier — Dedicated email support (24-hour response target)
8. Open Source and Self-Hosting
The core ProtonScheduler software is open source under the MIT License. This means:
- You may self-host ProtonScheduler for free, forever, for any purpose
- You may modify the source code to suit your needs
- You may use it commercially without restriction
- These Terms of Service apply only to our hosted cloud service, not to self-hosted instances
9. Intellectual Property
The ProtonScheduler name, logo, and branding are our trademarks. The open-source code is licensed under MIT. You may not use our trademarks to imply endorsement or affiliation without permission, but you may accurately state that your product uses or is built on ProtonScheduler.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim
- We are not responsible for the availability, security, or content of your Solid Pod, which is managed by your chosen Solid Pod provider
Nothing in these terms excludes or limits liability that cannot be excluded under applicable law (e.g. liability for fraud or personal injury).
11. Account Termination
11a. By you
You can delete your account at any time from your account settings or by emailing [email protected]. Upon deletion:
- Your account metadata is permanently deleted within 48 hours
- Any active subscription is canceled
- Your Solid Pod and all scheduling data remain untouched — they're yours
- Your subdomain becomes available for others after 90 days
11b. By us
We may suspend or terminate your account if:
- You materially violate these Terms (with notice and a reasonable opportunity to cure, where possible)
- You use the Service for illegal activity
- Your account has been inactive for more than 12 months (Free tier only; with 30 days' email notice before deletion)
In all cases, we will make reasonable efforts to give you time to export any account data before termination.
12. Changes to These Terms
We may update these Terms from time to time. For material changes:
- We will notify registered users by email at least 30 days before changes take effect
- Continued use after the effective date constitutes acceptance
- If you disagree with changes, you may close your account before they take effect
- Previous versions are available in our GitHub repository
13. Governing Law
These Terms are governed by the laws of the European Union and, where applicable, French law. Any disputes shall be submitted to the competent courts of Paris, France, subject to your rights under local consumer protection laws.
